By registering for or using Hermes OS you enter a binding agreement with — not yet provided —. If you are accepting on behalf of a business, you confirm you are authorised to bind it. The service is for business operators aged 18 or over.
Hermes OS provides AI agents that research, plan and draft work. Agents run under hard per-job and per-tenant spend limits, and every model call and tool call is recorded in an audit trail. All output — financial figures, legal or marketing copy, code, and analysis — is an AI-assisted draft and may be wrong. Agents cannot move money, and cannot publish externally. By default they cannot send email either — they draft, and you send. Outbound email can be switched on, but only by you and only deliberately: it requires the highest autonomy setting AND a separate explicit opt-in, uses sending credentials you supply, is capped per day, and every message is recorded. Until you do both of those things there is no path by which an agent can contact anyone. A human remains responsible for reviewing and approving external communications, payments, filings and contracts. Nothing produced by the system is legal, tax, medical or investment advice.
Hermes OS is licensed for legitimate commercial work. You agree not to use it for spam or bulk unsolicited messaging, malware, deceptive scraping, harassment, infringing others' rights, or anything unlawful in your jurisdiction. We may suspend an account for a serious or repeated breach, and will tell you why.
You keep all rights in the data you put in and the output you get out. You grant us only the licence needed to run the service for you — storing your data and transmitting it to the model provider that executes your missions.
The service is provided on an "as is" and "as available" basis. We do not currently offer a contractual uptime guarantee, and we would rather say so than publish a number we cannot honour. Third-party model providers may be unavailable or may change their pricing, which can interrupt execution.
To the maximum extent permitted by law, — not yet provided — is not liable for indirect, incidental, special, punitive or consequential damages, or for lost profits or data. Total cumulative liability is capped at the fees you paid in the 30 days before the claim. Nothing here limits liability that cannot be limited by law.
We may update these terms and will post the revised version here with a new date; material changes will be notified to your account email. Continued use after that constitutes acceptance. This agreement is governed by the laws of the jurisdiction named on the company details page, whose courts have exclusive jurisdiction.
